These Terms of Service govern your access to and use of DefiniteJobs.co.uk and the services provided through it.

Please read these Terms carefully. By creating an account, applying for a job, uploading a CV, posting a vacancy, purchasing a service or otherwise using DefiniteJobs, you agree to these Terms.

Our Privacy Policy also applies to your use of DefiniteJobs and explains how we collect, use and share personal information.

In these Terms:

  • “DefiniteJobs”, “we”, “us” and “our” mean DefiniteJobs Group Ltd;
  • “Candidate” or “Jobseeker” means a person using DefiniteJobs to search or apply for employment, upload a CV or use a career-related service;
  • “Employer” or “Recruiter” means a company, organisation, recruitment agency or person using DefiniteJobs for recruitment purposes;
  • “User”, “you” and “your” mean any person or organisation using DefiniteJobs;
  • “Services” means the website, candidate accounts, employer accounts, job listings, applications, CV services, recruitment campaigns, candidate access and other services provided by DefiniteJobs; and
  • “Content” means job advertisements, CVs, profiles, photographs, documents, messages, text and other material uploaded or submitted through DefiniteJobs.

2. ACCEPTANCE OF THESE TERMS

You may only use DefiniteJobs if you agree to these Terms and our Privacy Policy.

Where you use DefiniteJobs on behalf of a company, recruiter, agency or other organisation, you confirm that:

  • you are authorised to act for that organisation;
  • you have authority to agree to these Terms on its behalf; and
  • the organisation will be responsible for your use of the Services.

You must not use DefiniteJobs where doing so would be unlawful.

3. CHANGES TO THESE TERMS

We may update these Terms where necessary to reflect:

  • changes to our Services;
  • new products or features;
  • changes to our business;
  • security requirements;
  • changes in law or regulation; or
  • reasonable operational requirements.

The current version will be published on this page with its updated date.

Where a change materially affects existing users or an ongoing paid service, we may provide additional notice through the website, your account or email.

Changes will normally apply from the date stated in the updated Terms. Changes will not retrospectively alter an agreed purchase unless required by law or agreed with you.

4. CANDIDATE ACCOUNTS

Candidates may create an account by providing the information requested during registration or Quick Apply.

You must:

  • provide accurate information;
  • use an email address that belongs to you and that you can access;
  • keep your account information reasonably current;
  • create a secure password;
  • keep your password confidential; and
  • notify us promptly if you believe your account has been accessed without permission.

You are responsible for activity carried out through your account unless the activity resulted from a failure by DefiniteJobs to use reasonable care.

You must not:

  • create an account using another person’s identity without authority;
  • provide false or deliberately misleading information;
  • allow another person to impersonate you;
  • create accounts for fraudulent or abusive purposes; or
  • attempt to access another user’s account.

We may contact you using the email address associated with your account regarding applications, security, purchases and Services you request.

5. CANDIDATE PROFILES AND CVs

Candidates may upload or provide:

  • a CV;
  • contact details;
  • employment history;
  • education;
  • skills;
  • qualifications;
  • preferred roles;
  • profile information;
  • a profile photograph; and
  • other information relevant to their job search.

You remain responsible for the content and accuracy of your CV and profile.

You confirm that:

  • the information you provide is true to the best of your knowledge;
  • you have the right to upload and use the Content;
  • the Content does not infringe another person’s rights;
  • the Content is not fraudulent, unlawful, defamatory or deliberately misleading; and
  • uploaded files do not knowingly contain malware or harmful software.

DefiniteJobs may use automated tools to extract, organise, classify or match information contained in a CV.

These tools may identify information such as:

  • names;
  • email addresses;
  • telephone numbers;
  • locations;
  • job titles;
  • skills;
  • qualifications;
  • education; and
  • employment history.

Automated extraction may occasionally be incomplete or inaccurate. Candidates should review information displayed in their accounts and notify us of significant errors.

6. APPLYING FOR JOBS

When you apply for a job through DefiniteJobs, you instruct us to send or make your application information available to the employer or recruiter connected with that vacancy.

The information provided may include:

  • your CV;
  • your candidate profile;
  • your name;
  • your email address;
  • your telephone number;
  • answers submitted during the application process; and
  • other information you choose to provide.

Submitting an application does not guarantee:

  • that the employer will receive or review it immediately;
  • that the employer will respond;
  • that you meet the employer’s requirements;
  • an interview;
  • an offer of employment; or
  • any particular recruitment outcome.

The employer or recruiter is responsible for deciding whether to contact, interview or employ a candidate.

You should check that job information and communications are genuine before providing additional information, attending an interview, travelling or incurring expenses.

You should not send money, bank-login information or unnecessary sensitive information to a person claiming to offer employment.

7. OPTIONAL CV AVAILABILITY

Candidates may be offered an optional checkbox allowing their CV to be made available to employers and recruiters looking for similar roles.

This option is separate from applying for a specific job and is not selected by default.

Where you select this option, you authorise DefiniteJobs to:

  • include your CV and profile in an active candidate database;
  • search and filter your profile;
  • match your information with potentially suitable opportunities;
  • show or provide your CV and profile to employers and recruiters;
  • provide your contact details to employers and recruiters;
  • send your CV or profile to an employer or recruiter where we reasonably believe an opportunity may be relevant; and
  • contact you about potentially suitable roles.

Selecting this option does not guarantee that you will be contacted, interviewed or offered employment.

You may withdraw this permission at any time by contacting:

After your withdrawal request is processed, your profile will no longer be offered to new employers or recruiters under this permission.

Withdrawal does not automatically remove information already received by an employer or recruiter. That organisation may hold its own copy under its own legal responsibilities.

You may continue using DefiniteJobs and applying directly for advertised jobs after withdrawing CV-sharing permission.

8. JOB RECOMMENDATIONS AND CANDIDATE MATCHING

DefiniteJobs may use information from candidate profiles, CVs and job preferences to:

  • display relevant jobs;
  • recommend vacancies;
  • classify candidate profiles;
  • identify candidates who may be suitable for a vacancy; and
  • assist employers and recruiters with candidate searches.

Recommendations and matches are based on available information and automated or manual assessment. They are not guarantees that a vacancy or candidate is suitable.

DefiniteJobs does not make final hiring decisions for employers.

9. CV SCORING AND CV-REWRITING SERVICES

DefiniteJobs may offer free or paid CV-related services, including:

  • CV scoring;
  • automated CV analysis;
  • CV feedback;
  • CV parsing; and
  • CV rewriting.

CV scores, recommendations and rewritten documents are intended to assist the candidate. They do not guarantee:

  • improved search rankings;
  • compatibility with every applicant-tracking system;
  • an interview;
  • employment;
  • acceptance by an employer; or
  • any specific recruitment result.

Candidates remain responsible for reviewing rewritten or analysed documents before using them.

You should check that:

  • the information remains accurate;
  • dates and qualifications are correct;
  • no important information has been omitted; and
  • the final document properly represents your experience.

10. EMPLOYER AND RECRUITER ACCOUNTS

Employers and recruiters must provide accurate information about themselves and their organisations.

You confirm that:

  • you are using DefiniteJobs for genuine recruitment purposes;
  • you are authorised to act for the organisation associated with the account;
  • your contact and business information is accurate;
  • vacancies submitted by you are genuine;
  • you will comply with applicable employment, equality and data-protection laws; and
  • you will not misrepresent your identity, organisation or recruitment authority.

We may request information to help assess whether an employer or recruiter account is genuine.

Our checks may be limited and do not guarantee the identity, conduct, financial position or legitimacy of every account.

We may refuse, restrict or remove employer access where we reasonably believe that:

  • an account is false or misleading;
  • an organisation cannot be sufficiently identified;
  • candidate information may be misused;
  • a vacancy is unlawful or misleading;
  • payment is overdue;
  • the account presents a security risk; or
  • these Terms have been breached.

11. JOB ADVERTISEMENTS

Employers and recruiters are responsible for job advertisements they submit.

Every advertisement must:

  • concern a genuine employment or recruitment opportunity;
  • be accurate and not deliberately misleading;
  • clearly describe the role;
  • identify any material requirements;
  • comply with applicable employment and equality laws;
  • avoid unlawful discrimination;
  • avoid false salary, location or working-arrangement claims;
  • avoid requesting unnecessary sensitive information;
  • not promote unlawful activity; and
  • not infringe intellectual-property or other legal rights.

You must not advertise:

  • fake or non-existent vacancies;
  • pyramid or advance-fee schemes;
  • unlawful work;
  • opportunities requiring candidates to make improper payments;
  • roles intended to collect personal information without genuine recruitment; or
  • misleading business opportunities presented as employment.

We may edit formatting, request clarification, reject, suspend or remove an advertisement where reasonably necessary.

Publication by DefiniteJobs does not mean that we endorse, verify or guarantee the employer, vacancy, salary or working conditions.

12. USE OF CANDIDATE INFORMATION

Employers and recruiters may use candidate information only for genuine recruitment purposes.

Candidate information must not be used to:

  • advertise unrelated products or services;
  • send unrelated marketing;
  • build unrelated databases;
  • conduct bulk data harvesting;
  • sell candidate information;
  • resell access to candidate information;
  • publish a CV without permission;
  • contact candidates for fraudulent purposes;
  • discriminate unlawfully;
  • harass candidates; or
  • carry out activity unrelated to legitimate recruitment.

You must not disclose candidate information to anyone who is not reasonably involved in the relevant recruitment process, except where disclosure is legally required or made to an authorised service provider acting for you.

You must:

  • protect candidate information against unauthorised access;
  • limit access to people who need it for recruitment;
  • comply with applicable data-protection law;
  • provide candidates with any privacy information required from you;
  • honour applicable candidate rights;
  • stop using information when you no longer have a lawful reason to retain it; and
  • notify DefiniteJobs promptly of suspected misuse or unauthorised disclosure connected with the Services.

Payment for candidate access, applications or introductions does not transfer ownership of a candidate’s CV or personal information.

Candidates retain rights in their personal information and CV content.

13. PROHIBITED DATABASE ACTIVITY

You must not:

  • download candidate information in bulk;
  • scrape or systematically copy candidate profiles;
  • use automated software to extract information without written permission;
  • recreate any part of the DefiniteJobs candidate database;
  • share account access to avoid applicable charges or restrictions;
  • circumvent search, access, download or usage limits;
  • use candidate information for speculative mass emailing;
  • retain candidate information merely to create a future marketing database; or
  • provide database access to another person or organisation without our permission.

Candidate profiles must be considered individually in connection with genuine recruitment requirements.

Breach of this section may result in immediate suspension or termination of access.

14. RECRUITMENT OUTCOMES AND CHECKS

DefiniteJobs provides an online recruitment, advertising and matching platform.

Unless separately agreed in writing, DefiniteJobs:

  • is not the employer of any candidate;
  • does not become a party to an employment contract;
  • does not control an employer’s recruitment decision;
  • does not guarantee the identity or suitability of a candidate;
  • does not guarantee the identity or conduct of every employer;
  • does not guarantee qualifications, references or employment history;
  • does not guarantee that a candidate has a particular right to work;
  • does not negotiate employment terms on behalf of users; and
  • does not guarantee that a vacancy will result in a successful hire.

Employers and recruiters are responsible for carrying out checks appropriate to the role, which may include:

  • identity checks;
  • right-to-work checks;
  • reference checks;
  • qualification checks;
  • professional-registration checks;
  • criminal-record checks where lawful and appropriate; and
  • assessment of the candidate’s suitability.

Candidates are responsible for considering whether an employer, vacancy and proposed employment arrangement are suitable for them.

15. PAY-PER-APPLICATION SERVICES

DefiniteJobs may offer campaigns under which an employer or recruiter pays for candidate applications.

The applicable:

  • price;
  • campaign budget;
  • application target;
  • campaign period;
  • billing basis;
  • application criteria; and
  • any credit or replacement arrangements

will be shown before purchase, included in the order confirmation or agreed separately in writing.

An application does not guarantee that:

  • the candidate meets every stated requirement;
  • the candidate will respond to the employer;
  • the candidate will attend an interview;
  • the candidate will accept an offer; or
  • the campaign will result in a hire.

Unless the applicable order terms say otherwise, an employer must review applications and raise any genuine billing concern within a reasonable period after delivery.

We may investigate applications that appear to be:

  • duplicate;
  • test submissions;
  • fraudulent;
  • generated through a technical error; or
  • missing essential application information.

Any credit, replacement or adjustment will depend on the applicable campaign terms and the circumstances of the application.

16. CANDIDATE-DATABASE ACCESS AND INTRODUCTIONS

DefiniteJobs may charge employers and recruiters for:

  • access to opted-in candidate profiles;
  • individual CV access;
  • candidate searches;
  • candidate applications;
  • candidate introductions;
  • recruitment campaigns; and
  • related recruitment services.

Payment is for the recruitment, matching, introduction, access or platform service provided by DefiniteJobs.

Payment does not grant ownership of candidate information or permit its use outside genuine recruitment.

Access may be subject to:

  • account approval;
  • payment;
  • search or usage limits;
  • campaign restrictions;
  • technical controls; and
  • compliance with these Terms.

We may withdraw candidate access where necessary to protect candidates, comply with law, address security concerns or respond to misuse.

17. PRICES AND PAYMENT

Prices will be displayed on DefiniteJobs, at checkout, in an order confirmation, invoice or written service agreement.

Unless otherwise stated:

  • prices are in pounds sterling;
  • payment is required before the relevant service begins;
  • payments may be processed through WooCommerce and Stripe; and
  • you are responsible for providing accurate billing information.

The applicable VAT treatment, where relevant, will be shown during purchase or on the relevant invoice.

A service may be suspended where:

  • payment fails;
  • a payment is reversed;
  • an invoice is overdue;
  • payment information is fraudulent; or
  • a charge is disputed without a genuine basis.

We may recover properly due unpaid business invoices and reasonable recovery costs permitted by law.

Prices for future purchases may change. A price change will not alter a completed order or existing fixed-price purchase unless agreed with you.

18. CANCELLATIONS, CREDITS AND REFUNDS

Cancellation and refund rights may depend on:

  • the service purchased;
  • whether performance has started;
  • whether a job advertisement has been published;
  • whether an application or candidate profile has been delivered;
  • whether CV work has begun or been completed;
  • the specific order terms; and
  • whether the customer is acting as a business or consumer.

Where you purchase as a consumer, nothing in these Terms removes rights you have under applicable consumer law.

Where a purchased service has not begun, you may contact us to request cancellation.

Where DefiniteJobs cancels a paid service without providing the purchased service and the cancellation was not caused by your breach, we will provide an appropriate refund, credit or alternative service.

We are not required to refund a service merely because:

  • a candidate was not selected;
  • an employer did not respond;
  • an application did not lead to an interview;
  • a campaign did not result in a hire;
  • a candidate rejected an offer;
  • an employer later changed its recruitment requirements; or
  • a user changed their mind after the service was properly completed,

except where applicable law or the specific order terms provide otherwise.

19. MARKETING COMMUNICATIONS

Candidates may separately choose whether to receive relevant job and career communications from DefiniteJobs.

Marketing consent is optional and separate from:

  • creating an account;
  • applying for a job; and
  • agreeing to CV availability.

Marketing communications will include a method of unsubscribing.

Account, security, purchase, application and service-related communications are not marketing messages and may still be sent where necessary.

20. ACCEPTABLE USE

You must not:

  • use DefiniteJobs unlawfully;
  • attempt to gain unauthorised access;
  • interfere with website security;
  • introduce malware or harmful code;
  • overload or disrupt the website;
  • scrape or systematically extract information;
  • reverse engineer protected website functionality;
  • send spam;
  • impersonate another person or organisation;
  • use false payment information;
  • use DefiniteJobs to harass or deceive another person;
  • publish unlawful, defamatory or infringing Content;
  • use the Services to facilitate fraud;
  • bypass access, billing or account restrictions; or
  • encourage another person to breach these Terms.

You must not use information obtained through DefiniteJobs to cause harm to candidates, employers, recruiters or other users.

21. USER CONTENT

You retain ownership of Content you submit, including your CV, candidate profile or job advertisement.

By submitting Content, you grant DefiniteJobs a non-exclusive, worldwide, royalty-free licence to:

  • host;
  • store;
  • reproduce;
  • format;
  • process;
  • analyse;
  • display;
  • transmit; and
  • make the Content available

to the extent reasonably necessary to provide, operate, protect and improve the Services.

For candidates, this licence includes sharing application information with the relevant employer or recruiter and, where separately authorised, making a CV available for other suitable roles.

For employers, it includes publishing and promoting submitted job advertisements.

This licence ends when the Content is deleted from our active systems, except where continued retention is reasonably necessary for:

  • completed applications;
  • legal obligations;
  • security;
  • backups;
  • disputes; or
  • the establishment, exercise or defence of legal claims.

You confirm that you have the necessary rights and permissions to submit the Content.

22. DEFINITEJOBS CONTENT AND INTELLECTUAL PROPERTY

The DefiniteJobs website, branding, software, design, databases, text, graphics and other materials created by or for DefiniteJobs are owned by DefiniteJobs or its licensors.

You may use them only as necessary to access the Services.

You must not, without permission:

  • reproduce substantial parts of the website;
  • copy or recreate our databases;
  • use our branding in a misleading way;
  • remove copyright or ownership notices;
  • sell or license our website materials;
  • create a competing database using our Content; or
  • suggest that DefiniteJobs endorses you where it does not.

Nothing in these Terms transfers ownership of DefiniteJobs intellectual property to you.

23. THIRD-PARTY INFORMATION

Job advertisements, CVs and other Content may be provided by employers, recruiters, candidates or other users.

We may review or moderate Content, but we do not guarantee that all information is:

  • complete;
  • accurate;
  • current;
  • authentic; or
  • suitable for a particular purpose.

Users must make their own reasonable checks before relying on information provided through the Services.

24. SERVICE AVAILABILITY

We aim to keep DefiniteJobs available and functioning, but uninterrupted access cannot be guaranteed.

The Services may occasionally be unavailable because of:

  • maintenance;
  • software updates;
  • hosting problems;
  • security incidents;
  • internet or telecommunications failure;
  • third-party service failure; or
  • circumstances outside our reasonable control.

We may change, improve, replace or discontinue website features.

Where a change materially affects a paid service that has already been purchased, we will take reasonable steps to provide the service, an appropriate alternative, credit or refund where required.

25. SUSPENSION AND TERMINATION

We may suspend, restrict or terminate an account where we reasonably believe that:

  • these Terms have been breached;
  • information provided is false or materially misleading;
  • candidate information has been misused;
  • payment is overdue or fraudulent;
  • the account presents a security risk;
  • the account is being used unlawfully;
  • suspension is necessary to protect another user;
  • continued access could expose us or another person to legal harm; or
  • we are required to act by law or a competent authority.

Where appropriate and reasonably possible, we may provide notice or an opportunity to correct the issue.

Immediate action may be taken where necessary to address:

  • fraud;
  • unlawful conduct;
  • data misuse;
  • security threats;
  • harassment;
  • bulk extraction of candidate information; or
  • serious or repeated breaches.

Candidates may request account closure by contacting:

Account closure does not automatically remove information already supplied to employers or recruiters through completed applications.

Termination does not remove payment obligations or legal responsibilities that arose before termination.

26. OUR RESPONSIBILITY TO CANDIDATES AND CONSUMERS

We will provide our Services with reasonable care and skill.

We are responsible for losses that are a foreseeable result of our breach of these Terms or failure to use reasonable care and skill.

We are not responsible for losses that:

  • were not reasonably foreseeable;
  • were caused by inaccurate information supplied by another user;
  • resulted from an employer’s or candidate’s independent decision;
  • resulted from your own breach of these Terms; or
  • could reasonably have been avoided by following our instructions or taking reasonable precautions.

Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability for:

  • death or personal injury caused by negligence;
  • fraud or fraudulent misrepresentation; or
  • statutory consumer rights that cannot lawfully be excluded.

DefiniteJobs is not responsible for an employer’s recruitment decision or for the conduct of an employer, recruiter or candidate outside our control.

27. LIABILITY TO BUSINESS USERS

This section applies only where you use DefiniteJobs wholly or mainly for business purposes.

To the fullest extent permitted by law, DefiniteJobs will not be liable for:

  • loss of profit;
  • loss of revenue;
  • loss of anticipated savings;
  • loss of business opportunity;
  • loss of goodwill; or
  • indirect or consequential loss.

Our total liability arising from a particular paid service will not exceed the total fees paid or payable by you for the service giving rise to the claim during the 12 months preceding the event giving rise to the claim.

This limitation does not apply to liability that cannot lawfully be limited or excluded, including:

  • death or personal injury caused by negligence;
  • fraud or fraudulent misrepresentation; or
  • deliberate unlawful conduct.

Nothing in this section removes your obligation to pay properly due charges.

28. BUSINESS-USER RESPONSIBILITY FOR CLAIMS

Where you use DefiniteJobs for business recruitment purposes, you will be responsible for losses, costs or claims reasonably incurred by DefiniteJobs as a direct result of your:

  • unlawful job advertisement;
  • infringement of another person’s rights;
  • misuse of candidate information;
  • breach of data-protection obligations;
  • fraudulent activity; or
  • material breach of these Terms.

This does not apply to the extent that the loss was caused by DefiniteJobs’ own breach, negligence or unlawful conduct.

29. PRIVACY AND DATA PROTECTION

Our Privacy Policy explains how DefiniteJobs handles personal information.

Employers and recruiters who receive candidate information are responsible for complying with their own data-protection obligations.

Nothing in these Terms authorises a user to process personal information unlawfully.

Where these Terms and the Privacy Policy concern different matters, both documents apply. Where they directly conflict regarding our handling of personal information, the Privacy Policy will apply.

30. COMPLAINTS

Questions or complaints concerning DefiniteJobs should be sent to:

Please include:

  • your name;
  • the email address connected with your account;
  • the relevant order, vacancy or application;
  • a clear description of the issue; and
  • the outcome you are requesting.

We will review complaints and may request further information where necessary.

31. EVENTS OUTSIDE OUR CONTROL

We will not be responsible for delay or failure caused by circumstances outside our reasonable control, including:

  • internet or hosting failure;
  • telecommunications disruption;
  • cyberattacks;
  • utility failure;
  • fire;
  • flood;
  • severe weather;
  • industrial action;
  • government action;
  • civil emergency; or
  • failure of an essential third-party service.

Where such an event affects a paid service, we will take reasonable steps to reduce disruption and resume the service.

32. TRANSFER OF RIGHTS

You may not transfer your employer or recruiter account, purchased access or rights under these Terms to another person or organisation without our written permission.

We may transfer our rights and obligations as part of a genuine business reorganisation, merger, sale or transfer, provided this does not reduce any mandatory rights you have.

33. SEVERABILITY

If any provision of these Terms is found to be unlawful or unenforceable, the remaining provisions will continue to apply.

The affected provision will be treated as modified only to the minimum extent necessary to make it lawful and enforceable.

34. WAIVER

If we do not immediately enforce a provision of these Terms, that does not mean we have waived the right to enforce it later.

A waiver will only be effective where clearly confirmed in writing.

35. THIRD-PARTY RIGHTS

Unless expressly stated otherwise, these Terms do not give any person who is not a party to them a right to enforce them.

36. ENTIRE AGREEMENT FOR BUSINESS USERS

Where you use DefiniteJobs for business purposes, these Terms, the applicable order information and any written service agreement form the agreement between you and DefiniteJobs regarding the relevant Services.

A separately signed written service agreement will take priority where it expressly conflicts with these Terms.

Nothing in this section excludes liability for fraud or fraudulent misrepresentation.

37. GOVERNING LAW AND COURTS

These Terms are governed by the law of England and Wales.

Where you use DefiniteJobs as a business, the courts of England and Wales will have exclusive jurisdiction over disputes.

Where you use DefiniteJobs as a consumer, you retain any mandatory rights concerning the law and courts available to you in the part of the United Kingdom or other country where you live.
